People & Partners Pty Ltd ACN 607 886 508 and its related companies (collectively referred to as “P&P”, “us” or “we”) respect the privacy and security of your personal information and comply with the requirements of the Australian Privacy Principles (“APP”) under the Privacy Act 1988 (Cth) (“the Act”).
As a provider of accounting, advisory, taxation and wealth advisory services it may be necessary, and in some cases be a legislative and regulatory requirement, for us to collect and hold detailed personal information about you. Personal information is any information which might identify you or by which your identity might reasonably be determined. This Privacy Policy (“Policy”) explains how P&P handles this personal information (“Personal Information”).
You do not have to provide us with Personal Information but, if you do not provide the information we request, we may not be able to provide you with requested services.

WHAT PERSONAL INFORMATION DO WE COLLECT AND HOLD?

We collect the Personal Information that is necessary for us to manage your affairs. Such information may include your:

  • Gender
  • Date of Birth
  • Employment details and employment history
  • Tax File Numbers
  • Details of your financial circumstances, including bank account details, your assets and liabilities (both actual and potential), income, expenditure, insurance cover and superannuation
  • Health information (for some types of insurance cover)
  • Details of your investment preferences and aversion or tolerance to risk (if a wealth advisory client)

HOW WE COLLECT PERSONAL INFORMATION

The information we collect will generally be collected through our communications or dealings with you. However, we may also collect it from third parties including but not limited to your solicitor, third party service providers, banks, financial institutions, regulatory bodies and insurance companies. Depending on the type of services you are seeking, we may also conduct credit reports on our clients or collect your tax file numbers which are sensitive information.
In the course of providing our services, we collect personal information in a number of ways:

  • Electronically;
  • Via telephone;
  • Mail; or
  • Through our website.

P&P may also collect your personal information from a third party where:

  • You consented to the collection of information;
  • We are required or authorised under Australian law, court/ tribunal, or someone other than you; or
  • It is unreasonable or impracticable to obtain the information from you.
  • We may also collect personal information that is publicly available.

Regardless of how it is collected, we handle all Personal Information in accordance with this Policy.

USE AND DISCLOSURE OF PERSONAL INFORMATION

P&P generally uses personal and sensitive information to provide specified professional services, and to raise awareness about recent business-related developments that may be of relevance or interest. We may also share personal information internally within P&P and its related entities, in order to communicate information about our wide range of business services or latest business solutions.

Generally, P&P obtains your consent in writing or implied, prior to disclosing your personal information to a third party. However, in some circumstances we may use and disclose your personal and sensitive information where it is required or permitted by Law.

P&P may be required to provide your personal and sensitive information to:

  • Australian Taxation Office (“ATO”);
  • Australian Securities and Investments Commission (“ASIC”);
  • Financial planning institutions; and
  • Overseas recipients.

P&P may disclose information relating to you to subcontractors located outside of Australia in particular, the Philippines and India, in the provision of our services. We endeavour to ensure that such third parties comply with the APP’s, our privacy policy and confidentiality obligations under Australian jurisdiction.

By giving P&P your personal information, you consent to such transfer and disclosure. In addition, we believe that the recipients of such information are subject to a law, binding scheme or contract which effectively upholds principles for fair handling of the information that are identical or substantially similar to the applicable Australian privacy laws.

ACCESS AND CORRECTION OF PERSONAL INFORMATION

We take reasonable steps to ensure that the Personal Information we hold is accurate, complete and up-to-date. However, we also rely on you to advise us of any changes to the Personal Information.

On request we will provide you with access to the Personal Information we hold, including for the purpose of correcting or updating that information, unless otherwise required or permitted by law.

If we refuse to provide you with access we will provide you with written notice that, at a minimum, outlines reasons for the refusal and the complaints mechanisms available to you.

SECURITY OF PERSONAL INFORMATION

We take reasonable steps to protect the Personal Information that we hold from misuse, interference, and loss and from unauthorised access, alteration and disclosure.

However, data protection measures are never completely secure and, despite the measures we have put in place, we cannot guarantee the security of the Personal Information. You must take care to protect the Personal Information (for example, by protecting any usernames and passwords). You should notify us as soon as possible if you become aware of any security breaches.

WHAT IF YOU HAVE A COMPLAINT?

If you wish to make a complaint about a breach of this Privacy Policy or the Australian Privacy Principles of the Privacy Act 1988 (Cth) you can contact us using the contact details below. You will need to provide us with sufficient details regarding your complaint together with any supporting evidence.

We will investigate the issue and determine the steps that we will undertake to resolve your complaint. We will contact you if we require any additional information from you and will notify you in writing of the outcome of the investigation.

PRIVACY & SITE CHANGES

P&P may update this Policy from time to time so please review it periodically for changes. If the changes are significant or substantive, they will either be advised to you in writing or posted on our website at peopleandpartners.com.au

Your continued use of our websites or services, requesting our assistance or the provision of further Personal Information to us (directly or via an authorised person) after this Policy has been revised, indicates your acceptance of the revised Policy.
